LEVI ROOTS® TEXT TO WIN PROMOTION
FULL TERMS AND CONDITIONS

The following terms and conditions apply to the Levi Roots® Text to Win Promotion (the “Promotion”).

  1. These terms and conditions apply to the Promotion (the “Terms and Conditions”) and shall prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Please retain a copy for your information.
  2. By participating in the Promotion, you agree to be bound by the Terms and Conditions. Participation instructions (inclusive of any short form terms and conditions) are deemed to form part of the Terms and Conditions. For the avoidance of doubt, in the event of any contradiction between the Terms and Conditions and any short form terms and conditions, these Terms and Conditions shall take precedence. By participating, you will be deemed to have accepted and be bound by the Terms and Conditions.
  3. The promoter of the Promotion is Nichols plc (company number 00238303) of Laurel House, Woodlands Park, Newton-le-Willows, Merseyside, WA12 0HH (the “Promoter”).
  4. Fluid Vision Ltd (company number 07144855) of 3 Thorp House, Thorp Street, Macclesfield, Cheshire, SK10 1LJ is responsible for the administration of the Promotion and fulfilment of prizes (the “Partner”).
  5. The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes necessary to do so.

 

HOW TO ENTER

  1. The Promotion runs from 00:01 GMT on 1st April 2025 until 23:59 GMT on 31st May 2025 (the “Promotion Period”) and only applies to the purchase of Levi Roots® Energy products or Levi Roots® 500ml products (the “Products”) sold by certain outlets of AG Parfett & Sons Ltd (“Parfetts”), the Dhamecha Group (“Dhamecha”) and other wholesalers as determined by the Promoter (“Other Wholesalers”) (together the “Participating Wholesalers”).
  2. To participate in the Promotion:
    1. purchase at least one case of Products from Participating Wholesalers;
    2. text LEVI to 85100 (you will receive a reply text requesting, your full name, the name of the Participating Wholesaler and the location from where you made your purchase);
    3. upload and submit a clear photograph of your purchase or receipt through the Partner’s text to win service accessed via the link sent to you by the Partner in response to your entry.
  3. Internet access and a mobile capable of sending texts to short code numbers required for entry into the Promotion. Entry is by text only which will be charged at your standard network rate (please check with your provider). Always ask the bill payer’s permission before entering. If you text after the Promotion Period, you will not be entered into the Promotion, but you will still be charged.
  4. Only valid entries will be accepted. The Promoter reserves the right to refuse any uploaded photos which are not accompanied by the information requested above and/or are:
    1. out of focus or blurry;
    2. fall outside of the Promotion Period.
  5. The Promoter will not accept:
    1. responsibility for entries that are corrupted, not successfully completed or transmitted, lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, website, computer hardware or software failure of any kind; or
    2. proof of transmission as proof of receipt of entry into the Promotion.

 

ELIGIBILITY

  1. The Promotion is open to all residents of England, Scotland and Wales aged 18 years or over except employees of the Promoter or Partner, family members of employees of the Promoter or Partner, agents of the Promotor or Partner or anyone professionally connected with the administration of the Promotion.
  2. The Promoter reserves the right to verify eligibility and to disqualify any entrants if they have reasonable grounds to believe the entrant has breached any of the Terms and Conditions.
  3. Products included in the Promotion are subject to availability and whilst stocks last at Participating Wholesalers.
  4. Only one entry per person during the Promotion Period. For the avoidance of doubt only one unique mobile number will be accepted per person. Any use by entrants of identities other than their own and/or any entrant using multiple mobile numbers and/or any other methods to enter this Promotion will be disqualified and any prize entitlement will be void. The Promoter reserves the right to verify the unique identity of entrants using the data provided including but not limited to mobile number and payment details.
  5. The Promoter will not accept entries that are:
    1. automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
    2. completed by third parties or in bulk;
    3. incomplete.

 

PRIZES

  1. There are 5 prizes of £500 to be won as follows:
    1. 1 x prize of £500 is available to be won by entrants who purchase Products from Parfetts;
    2. 1 x prize of £500 is available to be won by entrants who purchase Products from Dhamecha;
    3. 3 x prizes of £500 are available to be won by entrants who purchase Products from Other Wholesalers.
  2. The winners will be drawn using a random number generator within 28 days of the end of the Promotion Period. Prizes will be paid directly into the bank account of the winners via BACS payment within 28 working days of prize acceptance. Winners will be required to have an English, Scottish or Welsh bank account to claim their prize.
  3. Only one prize per household. The prizes must be accepted as offered and redeemed by the named winners only. There is no alternative prize, in whole or part (save where the Promoter in its sole discretion deems it reasonably necessary to provide an alternative prize). The prizes are non-transferable and non-refundable.

 

WINNERS AND CLAIMING YOUR PRIZE

  1. The decision of the Promoter is final, and no correspondence or discussion will be entered into.
  2. Winners will be notified by text within 28 days following the end of the Promotion Period. It is the responsibility of the entrant to ensure that they respond to the winner notification. Winners who do not respond within 7 days of receiving the notification, will be phoned or texted again and given a further 7 days to respond. If contact cannot be made, or the prize is not claimed within 14 days of the initial winner notification date, an alternative winner will be drawn. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
  3. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

 

GENERAL

  1. By entering the Promotion, you are consenting to the processing of your personal data for the purposes of administering the Promotion.
  2. The Promoter will only process your personal data as set out below. If you enter this Promotion, we will use your data as follows:
    1. we will retain your details (full name, city and country of residence and email address);
    2. if you are a winner, we will also ask for your bank account details and we will use the data you have provided to administer your prize. We will delete all of your personal data within 94 days after the Promotion has closed;
    3. we will store your data on secure servers.
  3. You acknowledge that the Promoter may share your personal data with the Partner, solely for the purposes of administering the Promotion. Your personal data will at all times be kept confidential and in accordance with current data protection legislation. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to customercare@vimto.co.uk. All personal data submitted as part of the Promotion will not be used for any marketing purposes.
  4. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notifications or prizes. The Promoter will not be held liable to any individual for any fraud committed by any third party.
  5. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from the Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  6. Errors in printing, spelling or composition and similar errors have no value and cannot be invoked as a remedy against the Promoter.
  7. The Terms and Conditions are governed by the laws of England. Any claims and/or disputes arising out of or in connection with the Terms and Conditions shall be submitted to the exclusive jurisdiction of the English Courts unless you live in Scotland or Wales, in which case your local courts will have jurisdiction.
